if some one had a cat and moved and left the cat for 5+ months to roam around on the street...and then some one else started to take care of the cat doesnt that mean that they abandoned the cat and the cat is no longer theirs but belongs to the person that is now taking care of it??

I assume that you speak of a known case and that you want to find out the legal position? I couldn't find a definite answer on what the law states but your local shelter should know because they deal with stray animals all the time. Usually there is a "holding" period for stray animals during which the owner can claim their pet. After that period the animal is rehomed. The holding period is in the region of (a) week(s) not months. In the UK there was a case where a shelter was forced to reveal the address of the new owners because the previous owners claimed their cat after twelve days. (See the link below.) I'm sure that if the owners had come forward after five months they wouldn't have had much chance of achieving this.
Also, a shelter can charge a daily fee to cover the entire time that the animal was in their care when the owner comes to claim their pet. So in your case the person that cared for the animal for five months should be entitled to compensation for food, cat litter, medication, vet bills, etc., if the previous owner attempts to get the cat back. If the previous owners have been so negligent as to abandon their cat for five months it is unlikely that they will be willing to foot the bill and hopefully that should put them off trying to get the cat back.

yes it does.
If the person dumped the cat and left it to fend on its own they they can't come to get the cat. If they left the cat for that long they can no longer claim the cat is theirs. Did someone do that and is trying to get their cat back?
Yes it does, there is no doubt in my mind.
First of all, whoever did that is a sick person. A pet is a living thing and deserves the same love and respect you would give a child. You wouldn't just dump your child on the streets to fend for itself, right? So, whoever is trying to get their cat back (if this is the case..), they should really give it a rest. There is no way I would personally give their cat back to them. They don't deserve the cat and the cat deserves a better, more loving home.
Basically you would be considered to be the owner of a stray if you regularly feed it or do other things to take care of it and feed it.
To me the cat now belongs to the person that found it.
